GENERAL​

These Terms and Conditions of Sale are directed to the “Purchaser” related to a particular “Estimate”. It will be at ILUMINAR Lighting's sole discretion, that all deals of ILUMINAR Lighting Products are made dependent upon and explicitly reliant upon these Terms and Conditions of Sale. No alterations of this record, regardless of whether by Purchaser in its Purchase Order or something else, will have any impact or be official upon ILUMINAR Lighting if in contention with the costs, terms and conditions or stipulations expressed in the Estimate of these Terms and Conditions of Sale, except if explicitly consented to on record as a hard copy by an approved agent of ILUMINAR Lighting and contained in a Purchase Order Acknowledgment, regardless of whether such Purchase Order expresses that shipment after such Purchase Order comprises acknowledgment of the terms thereof.

COMPLIANCE WITH LAWS

ILUMINAR Lighting Products are not designed or intended for use in connection with the illegal manufacturing, cultivation, or production of controlled substances. ILUMINAR Lighting products are intended for commercial horticultural and research uses in accordance with applicable law. The lawful and proper use of ILUMINAR Lighting Products is a condition of their sale.  Any improper use of the ILUMINAR Lighting Products voids the warranty otherwise provided. Any illegal use of ILUMINAR Lighting Products could subject the Purchaser to severe fines, penalties and/or imprisonment under applicable law. Purchaser acknowledges that neither ILUMINAR Lighting, nor any of its agents, affiliates, directors, employees and associates may be held liable, responsible, or accountable for any type of damage, litigation, or other legal action, which may arise from Purchaser’s legal or illegal use of ILUMINAR Lighting products, websites, or consultation, and Purchaser agrees to indemnify and hold harmless ILUMINAR Lighting from and against any and all such liability.

PRICES AND TAXES

All costs thus are firm for Products requested inside thirty (30) days (except if in any case recorded on the statement) from the date of the Quotation as cited. Costs may be changed by ILUMINAR Lighting at its sole discretion and may ascend. Prices stated herein do not include taxes, insurance, VAT, customs or excise taxes, special packaging, installation, freight, handling, or any other shipping charges unless these items are specifically listed and priced in the Quotation. 

 

PAYMENTS

ILUMINAR Lighting may offer the following payment options:

Below listed are the current accepted payment options. ILUMINAR reserves the right to remove or change any of the listed payment options at any time. ILUMINAR Lighting also reserves the right to add fees or conditions to the payment terms if banking surcharges change. This change will be noted to the active accounts in our system with a 30(thirty) day notice of the change. Fees and surcharges are subject to change and can be out of the control of ILUMINAR Lighting as the payment companies are not related or operate directly with ILUMINAR Lighting policies.

Payment of these invoices are due immediately upon receipt of invoice and shall be made in US funds. (Unless the invoice states account credit terms or is received in a different currency) 

 

PAYMENT TERMS

Payment by the Purchaser shall be made immediately or if different it will be clearly stated on each invoice, unless otherwise approved in advance in writing by ILUMINAR Lighting Accounting department. In the event an invoice becomes past due, ILUMINAR Lighting reserves the right to collect from the Purchaser a 1.5% monthly interest fee on all past due accounts. Terms on invoices are only given prior to the creations of the invoice and must be approved by ILUMINAR Lighting Accounting department, with all needed documentation filled out and signed by an authorized signer or buyer/ Owner/ Partner of the Purchasers account.

SECURITY INTEREST​

For the purpose of securing payment of the price of ILUMINAR Lighting Products and all other charges payable to ILUMINAR Lighting hereunder, Purchaser hereby grants to ILUMINAR Lighting a security interest in each and every Product delivered to Purchaser under these Terms & Conditions of Sale, including without limitation any proceeds from its resale or distribution or from insurance held by Purchaser covering such Products. Upon request by ILUMINAR Lighting, Purchaser shall cooperate with ILUMINAR Lighting and execute any necessary documents to perfect ILUMINAR Lighting’s security interest granted herein, where required by state law. These interests will be deemed satisfied and deemed released by payment in full of the purchase price and all other charges payable hereunder for each such Product.

 

 

 

SHIPMENT

 

Products shall be delivered to the Purchaser or its carrier, from one of ILUMINAR Lighting’s facilities (unless otherwise stated) and title and risk of loss to each Product sold by ILUMINAR Lighting to Purchaser shall pass to Purchaser upon delivery to the carrier at ILUMINAR Lighting’s facility.  Special shipping instructions must be received from the Purchaser three (3) business days before the shipment date; (and if these instructions need to be added to future purchases) otherwise, ILUMINAR Lighting reserves the right to use its judgment in selecting the means of shipment. Any additional shipping cost incurred at the request of the Purchaser will be charged to the Purchaser. Unless otherwise agreed in writing, ILUMINAR Lighting’s standard packaging will be used.  If the Purchaser cannot accept delivery of Products, Purchaser will arrange for storage and shall incur all costs for such storage. ILUMINAR Lighting shall not be liable for any delays in transit of products or services provided or purchased from ILUMINAR Lighting. ILUMINAR Lighting shall not be liable to or responsible for any damages or loss for delay or default in delivery due to any cause outside of ILUMINAR Lighting’s reasonable control, nor shall Purchaser cancel or have the right to cancel its Purchase Order because of delays or default in delivery due to such cases. 

 

Damages from shipping must be claimed at time of receipt with the delivery carrier or shipping company. Damages not stated at the time of receipt cannot be claimed at a later time. ILUMINAR Lighting has no control over this process and is not liable for damages by shipping companies if no additional insurance was added to an order.

 

Requests to cancel or modify all or any part of a Ocean Purchase Orders(Volume or Back orders included) by Purchaser may be granted by ILUMINAR Lighting if cancelation is made more than thirty (30) days before the estimated shipping date, subject to a restocking fee of up to 40% for any Products for which a Purchase Order is canceled. Furthermore, no cancellation or modification of Purchaser’s Purchase Order may be made on the order date if the shipping date and order date are the same day or less than 30 days, and the order has already been processed. 

 

WebStore orders may only be canceled within 1-2 hours from transaction time (listed on the website sale order) as long as the order has not been processed or shipped.

 

PURCHASER PROVIDED SHIPPING DETAIL

Purchaser must provide accurate details on the delivery location or additional charges will be applied at the conclusion of the delivery. (approximate costs are listed below, actual costs may vary depending on circumstances)

  1. Shipping location (Commercial, Farm or Remote Area, Residential etc.)

    1. The type of Delivery location can create many issues including:

      1. Delays of delivery

      2. Cancellation due to unforeseen delivery type (e.g. Dirt road to farm)

      3. Drivers not identifying location if no address is present

      4. Additional charges for multiple delivery attempts

  2. Inside Delivery request ($50 - $200 additional)

  3. Liftgate request (LTL orders) ($100 - $200 additional)

  4. Signature request (small parcel orders) ($7 to $20)

  5. Receiving Hrs. / Days ($100+ for re-delivery)

  6. Delivery appt. Request ($100+ for re-delivery)

  7. Notify Consignee before delivery request (Delays)

  8. Any additional special delivery Instructions (Delays or charges)

SHIPMENT CANCELLATION

POLICY

Every canceled shipment will incur:

  1. Total shipping costs to the Purchaser, both from the departure facility and the return costs to the facility.

  2. Restocking fee of 5%-40% of the total value returned, depending on the length of time products are returned in. (transit time back to ILUMINAR not included, must have live tracking)

    1. 1 Week of receipt - 5%

    2. 7+ Days to 14 Days - 10%

    3. 14+ Days - 15%

    4. 30+ Days - 25%

    5. 60+ Days - 40%

    6. No Canceled Orders accepted back after 60 days. 

  3. Credit Card fees will never be refunded on canceled orders 

  4. Orders cannot be canceled in transit, to avoid restocking fees.

  5. Orders are only credited once the product(s) are received back and inspected for condition.

  6. Contact Support Team to process any return of any item(s) from ILUMINAR Lighting

SHIPMENT DAMAGE POLICY

  1. Any damages on any shipment must be reported to the delivery carrier upon receipt.(at or before signing for receipt)  

    1. The carrier must note all damages on the delivery or the BOL depending on the type of shipment, this information must be given to the Carrier that delivered the shipment prior to them leaving the location. 

    2. If damages are severe, you may decline acceptance of delivery based on damage to the shipment

    3. Contact ILUMINAR Lighting immediately if this occurs so the carrier can be notified immediately of the loss. || support@iluminarlighting.com || 877-540-5588 ext 117 || 702-747-4770 

    4. Pictures of damaged shipments are required to prove the condition of the product upon receipt and must be emailed to support@iluminarlighting.com within 24 hours to receive any credit or replacements on the shipment. Damaged Packaging or internal boxes without damage to the actual product(s) does not always validate a damage claim against the carrier or the product(s). Please inspect all shipments that might show significant damages.

  2. Purchaser will be responsible for return shipping damages of items returned to ILUMINAR Lighting, which are inspected and evaluated on receipt at the ILUMINAR Shipping and Logistics facility. 

    1. Damage charges may include:

      1. Retail Packaging Damage (Must be in Saleable an NEW condition) -5%

      2. Damage Fixture (-5% to -100% depending on damages)

      3. Water damage (-10% to -100% depending on damages)

      4. Shipping or carrier damages or loss with no shipping insurance (-10% to -100%)

      5. Internal malfunctioning due to rough or damaged shipping (0%-100%)

  3. If a package has been left at a recipient's door, office or drop location and damages were not able to be noted on the “small pack” item(s), contact ILUMINAR Lighting immediately to receive instructions on how to proceed. See item #2 for other requirements (LTL shipments are unable to be dropped without a signature on the BOL) 

  4. Short Shipments must be reported within 24 hours of the digital delivery time of the shipment to validate a claim against the carrier or ILUMINAR Lighting.  A validation process can take 48-72 hours to validate packing weights and dims of packed items(verified from shipping carriers), packing slips, packing video camera footage, and other systems put in place to verify packing procedures and accuracy.  We take great strides to make sure that our packing procedures fall below .005% picking errors annually. 


 

PRIVATE POLICY

 

We are the sole owners of the information assembled by our associated channels. We simply gather the information that you willingly give us by methods of email, calls, social channels, site structures, or other direct contact from you. We won't sell or distribute this information to anyone. We will use your information to respond to you, regarding the clarification of details and reason for outreach. We won't share your information with any outside parties, other than to complete business related activities relating to you. Unless you ask us not to, we may contact you through email later on to inform you concerning specials, new products, or changes to this security agreement. 

 

YOUR ACCESS TO AND CONTROL OVER INFORMATION 

 

You may stop future contact or update your preferences with us at any point. You can do this by contacting us through the email address or phone number given on our site.

 

Change/Update any data we have about you. 

 

Request that your own information be forever eradicated; or 

 

Request to be removed from any arrangements or promoting correspondences. 

 

Protection of children’s personal information

 

Our organization is arranged for business in a manner that we don't deliberately collect data from anyone under the age of 18. If you are under 18, do not try to enroll for the site or send any personal data about yourself to us. If we find that we have acquired data from an individual under the age of 18, we will delete that information once informed. 


 

LIMITED WARRANTY

This limited warranty does not cover any damage resulting from an improper installation or removal that was not performed by a licensed electrician, deterioration or malfunction resulting from any alteration, modification, unauthorized attempted repair, improper or unreasonable use or maintenance, misuse, accident, or neglect or environmental conditions outside of product specifications. Customers are responsible for proper circuit breakers and proper wiring for their own protection. The ILUMINAR Lighting Warranty covers products from the ship date from the ILUMINAR Lighting Manufacturing and logistics facility for the period stated for the specific product warranty term. ILUMINAR Lighting reserves the right to invalidate any warranty prior to the end of the warranty term if any of the above stated conditions are met or if ILUMINAR Lighting feels that the products were used improperly or abused in a way where the products became non-functional. ILUMINAR Lighting Warranty does not cover shipping costs related to valid or untested warranty claims.

 

MIS-INSTALLED LAMP ERRORS are considered a USER or INSTALLATION error and are NOT considered a warrantable claim.

Enquire directly to ILUMINAR Lighting Sales Team for our new Extended Warranty program which can be applied to any fixture purchase made within the last 30 days and will protect your fixture against some accidental failures and extend shipping coverage (North America Continental only applies) for all warranty evaluations back to our facility.

ILUMINAR accepts no liability for problems caused by the Purchaser, electrician’s workmanship, hardware modifications, or additions. ILUMINAR will not warranty problems arising from an act of nature (lightning, flooding, tornado, etc.), electrical spikes or surges, or problems arising out of additional devices, circuit overloads, poor wiring, humid environments, direct sunlight, water damage, un-grounded connections, and temperatures above or below the tolerances of the product.

 

It is not recommended to use a flip box system, power bars, non-listed (Electrical connection panels without ETL or UL certifications) panels with electronic ballast, or to require a ballast to be in operation 24 hours a day with “no rest” will cause stress and potential damage to the ballast components. ILUMINAR Lighting is not responsible for any loss of work (“downtime”) caused by a product requiring service. This warranty is null and void if the defect or malfunction was due to damage resulting from operation not within manufacturer specifications. ILUMINAR Lighting will not be held responsible for typographical errors on sales receipts, repair tickets, or on our or vendor websites. 

ILUMINAR is not responsible for giving any technical support concerning the installation, electrical layouts, or integration of third party merchandise (e.g. Other controllers, cabling, environmental sensors, etc.)  ILUMINAR Lighting Products are all industrial grade products and fixtures and require the expertise of qualified, certified/ licensed installers, electricians and commercial contractors to ensure the products used have required electrical connections, amperage and voltage requirements(inrush current variations) that adhere to the local requirements and codes where these products are to be used. These industrial fixtures require massive amounts of power to run and can cause large draws of power when initially powered on 

 

If you are using a custom control panel it must be a UL listed panel and adhere to UL 508a standards.

All ILUMINAR Lighting Products with a serial number must be registered online with the serial number and purchase date within 30 days of the purchase to receive the full standard warranty for ILUMINAR products from the date of original purchase. If the original purchase receipt is not found, the date will be determined using the shipping date from the ILUMINAR Lighting facility.

 

Other exceptions to the above stated standard warranty are as follows:

 

  • All ILUMINAR Ballasts/ Fixtures are covered by a standard three (3) year Limited warranty for hardware electronics.

  • All ILUMINAR Reflectors are covered by a 30 day warranty, for specific damages or defects to the manufacturing process of a reflector.

  • ILUMINAR HASH Controller has a one (1) year prorated limited warranty.

  • ILUMINAR Touch Controller has a three (3) year prorated limited warranty.

  • ILUMINAR Lamps are covered by a 90 day warranty and a one (1) prorated warranty after the date of sale or, if unknown, after the date of manufacture, provided that such lamps are operated on ballasts and fixtures that meet ANSI specifications.

  • ILUMINAR LED fixtures are covered by a standard three (3) year with an additional two (2) year extended Warranty

 

ANY OTHER BRANDED PRODUCT SOLD BY ILUMINAR LIGHTING IS SUBJECT TO THAT BRAND’S WARRANTY POLICIES AND ILUMINAR LIGHTING ACCEPTS NO LIABILITY TO OTHER BRANDS’ FAILURES OR NON COMPATIBILITY TO ILUMINAR LIGHTING PRODUCTS. IT IS ALWAYS ILUMINAR LIGHTING RECOMMENDATION TO USE ILUMINAR LIGHTING PRODUCTS WITH OTHER ILUMINAR LIGHTING PRODUCTS, AS THEY WERE TESTED AND DESIGNED TO WORK TOGETHER.

The original buyer is the only party covered under the following Limited Warranties. These warranties are not transferable to purchasers or new product owners unless specific written consent is given from ILUMINAR Lighting to transfer the coverage. All products must be purchased from an authorized ILUMINAR Lighting distributor.

 

ILUMINAR reserves the right to modify, alter and improve any Product part or parts without incurring any obligation to replace any Product previously sold without such modified, altered, or improved part or parts.

 

REQUIREMENTS TO BE INCLUDED WITH A RETURN OF ANY ILUMINAR LIGHTING PRODUCT(S):

 

  1. UNDAMAGED COMPLETE FIXTURE/ BALLAST or LAMP or CONTROLLER

  2. ALL POWER AND CONNECTION CORDS TO PROPERLY RUN THE FIXTURE

  3. ALL INCLUDED LAMPS/ LED BARS OR FIXTURE HANGERS

  4. COPY OF ORIGINAL RECEIPT or INVOICE with DATE OF PURCHASE (this can be emailed prior to RMA)

  5. ORIGINAL ILUMINAR BOX or Alternative Packaging

    • Serial Number Marked on outside of Packaging

    • If the original box is not available, the RMA must be safely secured in package to prevent all damages during returns

    • ILUMINAR Lighting will only cover the costs of original Box dimensions, oversized RMA box shipping charges can be billed to the Purchaser, at ILUMINAR Lighting’s discretion  on a case by case basis.

  6. NO Items will be accepted without packaging of some type. 

 

ANY ITEMS MISSING FROM THE REQUIRED LIST CAN PRORATE THE VALUE OF THE RMA CREDIT ISSUED TO THE CUSTOMER. If an ILUMINAR Lighting Product is returned with multiple items missing to accurately be able to Bench test the unit or has been abused or damaged, upon inspection, the unit may be disqualified from the Warranty policy. Which may include but not limited to; Damaged Driver or Ballast Cases, Damaged Reflectors, Damaged Lamp sockets, Burned Cord connections, Missing Control Knobs, Missing LED bars, Cut or Burned Connection Cords, Damages caused by poor packaging or lack of packaging or other items that are caused or due to misuse or abuse of the product. The ILUMINAR Lighting Warranty covers only defects that could have occurred during the manufacturing process. Purchasers requesting an advance replacement will be required to provide payment information for a replacement unit which ILUMINAR will keep as a pending charge for the original cost of the item. If ILUMINAR does not receive the defective unit back within 25 days from the shipment of the replacement, ILUMINAR will process the pending charge against Purchaser’s credit card and the replacement unit will no longer be accepted for return by ILUMINAR.

 

ILUMINAR Lighting will bench TEST and EXAMINE all returned and received RMAs to ensure it is defective and not user or installation error. 

 

NOTE: If an item is returned that tests to be functional, we will ship it back to you at the customer expense and charge an additional $15 USD Testing Fee, and the customer can be billed for the inbound shipping costs that ILUMINAR lighting covered to initiate the RMA process. 

 

​It is the discretion of ILUMINAR Lighting to provide one of the following two remedies to satisfy a claim filed under this Limited Warranty. The Purchaser is REQUIRED to contact and test all RMA products to ensure they are defective prior to receiving an RMA number. 

 

  1. REPLACE product with the same or similar product deemed by ILUMINAR Lighting to perform the same function as the original product.

  2. ISSUE A CREDIT TO RETAILER: A prorated credit will be issued good for a purchase from the original retailer to replace the lamp or fixture, less depreciation based on the age of the product at the time remedy is sought under this limited warranty (see following for time frames, some exception apply):

 

ILUMINAR Ballasts or Fixtures: Three (3) year pro-rated Limited Warranty

  • Less than 1 year: N/A (credit or replacement only, similar or like product)

  • Greater than 1 year but less than 2 years: 75% off replacement cost at the time of replacement

  • Greater than 2 years but less than 3 years: 50% off replacement cost at the time of replacement.

  • Greater than 3 years: Out of warranty, contact ILUMINAR for options.

 

ILUMINAR LED Fixtures: Five (5) year pro-rated Limited Warranty

  • Less than 1 year: N/A (credit or replacement only)

  • Greater than 1 year but less than 2.5 years: 75% off replacement cost at the time of replacement

  • Greater than 2.5 years but less than 5 years: 40% off replacement cost at the time of replacement.

  • 5 years and longer: No discount, some replacement parts can be supplied at shipping and parts cost.

 

ILUMINAR Controllers: Three (3) year pro-rated Limited Warranty

  • Less than 1 year: N/A (credit or replacement only)

  • Greater than 1 year but less than 2 years: 75% off replacement cost at the time of replacement

  • Greater than 2 years but less than 3 years: 50% off replacement cost at the time of replacement.

  • 3 years and longer: No discount, some replacement parts can be supplied at cost.

 

ILUMINAR Lamps: One (1) year pro-rated Limited Warranty

  • Less than 4 months: N/A (credit or replacement only)

  • Greater than 4 months but less than 8 months: 50% off replacement cost at the time of replacement

  • Greater than 8 months but less than 12 months: 25% off replacement cost at the time of replacement.

  • 12 months and longer: No discount. HID Lamps(HPS, CMH & MH) are rated at a 12 month Lifespan.

ILUMINAR Reflectors: One (1) year pro-rated Limited Warranty

  • Less than 4 months: N/A (credit or replacement only)

  • Greater than 4 months but less than 8 months: 50% off replacement cost at the time of replacement

  • Greater than 8 months but less than 12 months: 25% off replacement cost at the time of replacement.

  • 12 months and longer: No discount

If a product is returned to ILUMINAR Lighting or the authorized dealer from which it was purchased or any other party authorized to repair ILUMINAR Lighting products, the product must have live tracking and be insured during shipment, with the insurance and shipping charges prepaid by the sender. If a product is returned non-tracked or uninsured, senders assume all risks of loss or damage during shipment. ILUMINAR Lighting will not be held responsible for costs related to the removal or re-installation of this product into or from any installation. ILUMINAR Lighting will not be responsible for any costs related to any set-up of this product, any adjustment of user controls, or any programming required for a specific installation of this product.

To obtain a remedy under this limited warranty, you must contact either the authorized ILUMINAR Lighting reseller from whom you purchased the Product or the ILUMINAR Lighting distributors office or reseller nearest you. AUTHORIZED DEALER

In order to pursue any remedy under this limited warranty, you must possess an original, dated receipt as proof of purchase from an Authorized ILUMINAR Lighting reseller. If this product is returned under this limited warranty, a return authorization number, obtained from an authorized Distributor, will be required (RMA number). You may also be directed to an authorized reseller or a person authorized by ILUMINAR Lighting to repair the product. If it is decided that this product should be returned directly to ILUMINAR Lighting, this product should be properly packed, preferably in the original carton, for shipping. Cartons not bearing a return authorization number will be refused.

VOIDED WARRANTY

This limited warranty gives you specific legal rights, and you may have other rights that vary from country to country or state to state. The ILUMINAR Lighting Warranty will be null and void in the case of a willing or accidental violation of our safety and/or installation instructions. Please be sure to read instructions carefully and contact our customer service department with additional questions. 

Situations that can VOID the ILUMINAR Lighting Warranty include but are not limited to: 

  • The Product was not purchased from ILUMINAR Lighting or from an authorized ILUMINAR Lighting reseller

  • ILUMINAR Lighting product not used as intended or properly, listed under specification; 

    • Examples: 

      • Horticultural indoor light used outside in open weather

      • Fixture run at lower power setting than required to operate

      • Set in below 32ºF greenhouse prior to use where the spec sheet states it should not be in Freezing temperatures.

  • Product has visible tampering (the customer attempted to repair on their own accord)

    • “Tampering” is defined as:

      • Taking fixture apart in anyway out side of normal functions

      • Removing screwed or fastened plates or mounts

      • Damaging or removing reflector arms (HID Fixtures)

      • Torn or stripped power cables, or removing power cables from fixtures

      • Missing parts from original condition

  • The label bearing the serial number has been removed or defaced

  • Missing original purchase receipt 

  • Physical damage (intentional or accidental) which may include: dents, stripped screws, water damage, burns due to improper wiring or electrical overload, chemical odors, visible indication of misuse (e.g. outdoor/non-greenhouse use)

  • The use of Sulfur vaporizers. Do NOT use sulfur vaporizers.
     

IF ANY OF THESE MENTIONED ITEMS ABOVE HAVE OCCURED, YOUR WARRANTY MAY BE CONSIDERED AS INVALID.

LIMITATION OF LIABILITY

THE MAXIMUM LIABILITY OF ILUMINAR LIGHTING UNDER THIS LIMITED WARRANTY SHALL NOT EXCEED THE ACTUAL PURCHASE PRICE PAID FOR THE PRODUCT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ILUMINAR LIGHTING IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY. Some countries, districts, or states do not allow the exclusion or limitation of relief, special, incidental, consequential, or indirect damages, or the limitation of liability to specified amounts, so the above limitations or exclusions may not apply to you.

EXCLUSIVE REMEDY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIS LIMITED WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ILUMINAR LIGHTING SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF ILUMINAR LIGHTING CANNOT LAWFULLY DISCLAIM OR EXCLUDE IMPLIED WARRANTIES UNDER APPLICABLE LAW, THEN ALL IMPLIED WARRANTIES COVERING THIS PRODUCT, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, SHALL APPLY TO THIS PRODUCT AS PROVIDED UNDER APPLICABLE LAW. IF ANY PRODUCT TO WHICH THIS LIMITED WARRANTY APPLIES IS A “CONSUMER PRODUCT” UNDER THE MAGNUSON-MOSS WARRANTY ACT (15 U.S.C.A. §2301, ET SEQ. ) OR OTHER APPLICABLE LAW, THE FOREGOING DISCLAIMER OF IMPLIED WARRANTIES SHALL NOT APPLY TO YOU, AND ALL IMPLIED WARRANTIES ON THIS PRODUCT, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR THE PARTICULAR PURPOSE, SHALL APPLY AS PROVIDED UNDER APPLICABLE LAW.
